Article 2 – Access to the Site
Browsing the Site is free and open to all.
Cémoi Chocolatier reserves the right, for any reason and at its sole discretion, to terminate, modify, suspend or discontinue access to all or part of the Site, including in particular its content, its features or its hours of availability, without prior notice.
Article 3 – Respect for intellectual property rights
This Site and all of its content (including but not limited to: trademarks, logos, visuals, creations, graphic, textual and software elements of the Site, illustrations and photographs) are protected by intellectual property rights. It is therefore strictly forbidden to use, distribute, copy, reproduce, modify, misrepresent or transmit the Site or any element of the Site such as text, images or sound, without the prior written authorisation of Cémoi Chocolatier. The trademarks and logos appearing on the Site are the property of Cémoi Chocolatier or are used under licence. No right or licence may be granted over any of these elements without the prior written authorisation of Cémoi Chocolatier or of the third party holding the rights to the trademark or logo appearing on the Site. Cémoi Chocolatier reserves the right to take any action on the basis of its intellectual property rights, including criminal proceedings.
Article 4 – Use of personal data
A – French Data Protection Act
The Publisher may collect personal data when a user subscribes to the Newsletter. The data collected (in particular surname, first name, postal address, date of birth and email address) is required in order to receive the Newsletter. It is intended for the Publisher for the sole purpose of performing the services offered by the Site. It may be passed on to the subcontractors or service providers used by the Publisher for the automated processing described above.
In addition, certain data may be published on the Site as part of the activities offered by the Site (in particular first name, age, photograph, département). The User consents to such data being published when taking part in the activity concerned.
In accordance with French Data Protection Act No. 78-17 of 6 January 1978 as amended, users and, where they are minors, their legal representative, have a right of access to, rectification of and erasure of the personal data collected by the organising company. B – Use of IP addresses
An IP address is the numerical identifier automatically assigned to every computer by its Internet service provider.
This address is recorded as a matter of course when the pages of the transparence-cacao.fr Site are viewed.
The Publisher collects IP addresses in order to manage its own computer system and to analyse how its Site is used. They are not linked to any personal information, which means that visits are recorded but that the anonymity of each user is preserved.
C – Advertising email
When users enter their email address on the Site when subscribing to the Newsletter or taking part in a prize draw, they may consent to receiving all offers from the Publisher or offers from its partners. Subscribing to the Newsletter means receiving all offers from the Publisher.
At the end of every advertising email or Newsletter sent by the Publisher, the user is given the option of refusing any further advertising email or of unsubscribing from the Newsletter with a single click. D – Use of cookies
A session cookie is used to manage the integrity of the connection. It self-destructs and records no information on the user’s computer.
Article 5 – Exclusion of liability
Cémoi Chocolatier and any other party involved in connection with the Site may not be held liable for any damage that may result from accessing or using the Site or the information it contains, in particular in the event of damage or viruses that may infect the user’s computer equipment or any other property.
Although Cémoi Chocolatier makes reasonable efforts to keep the accurate information published on the Site up to date, it may not be held liable for any error or omission.
